CCI Limited Warranty for Surge Control™ Products

Seller warrants that the Surge Control™ product (the "Product") purchased hereunder is free from defects in materials and workmanship under normal use for a period of five (5) years from the date of shipment by Seller to the original purchaser. Seller will replace or repair any Product that fails to perform as warranted on a replacement basis. If Seller is unable to repair or replace the warranted Product, within a reasonable time, Seller will replace the Product with a functionally equivalent Product. Warranty claims will be processed by the Seller when submitted in writing and after the warranted Product has been returned for analysis by the Seller.

If the Purchaser believes that the warranted Product may be defective, the Purchaser shall ship or deliver the Product, properly insured, to the Seller at Purchaser’s own cost.

Purchaser has a responsibility to install the Product in conformance of applicable agency requirements or recommendations such as NEMA, UL, F.M., and Seller’s product installation recommendations.

This warranty shall be voided if any of the following occur: a) any failure that results from an accident, Purchaser’s abuse, neglect or failure to operate products in accordance with instructions or specifications provided by the Seller; b) any failure that is the result of electrical overstress that exceeds the Product specification; or c) damage to any Product not installed according to NEMA or other professional standards and according to the Seller’s installation recommendations.

This limited warranty is intended to supplement the terms of the Seller’s standard Work Initiation Notice and does not alter any of it provisions.

THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER ORAL, WRITTEN, EXPRESS OR IMPLIED, AND THE REMEDIES SET FORTH ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDY. ANY IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. SELLER SHALL NOT, IN ANY EVENT, BE LIABLE FOR ANY INCIDENTAL, INDIRECT OR CONSEQUENTIAL LOSS, DAMAGE OR EXPENSE THAT MAY RESULT FROM ANY DEFECT, FAILURE OR MALFUNCTION OF ANY SURGE CONTROL PRODUCT.
